Default SCOTUS says mandate stays as a tax.

SCOTUS just ruled the mandate stays, as a tax. Doesn't jive with Commerce clause but stays as a tax.

That's what I'm hearing too.

Cato Source

So Congress can call anything a tax, and force us to do whatever they want under that provision of the constitution.

Bye bye, Sweet America!

As of 1 hour ago, Welcome to The Socialist States of America. Worst part of the decision, we all get to watch Pelosi chest-pound.

But Congress did NOT call it a tax - these five idiots in black robes called it a tax. WASS.

Tim Sandefur of the Pacific Legal Foundation just completed his analysis of this morning's travesty.

If I understand correctly, Sandefur is happy because of the 5-4 ruling that the mandate cannot be applied under the commerce clause, something he calls a long term Good Thing. And by calling the mandate a tax, this is more limiting, and something the Court says they will re-evaluate as the cases come up. Not sure I understand that, but who am I?

There is also a ruling regarding Medicare, but that one completely lost me.

I will post the link to A%G's podcast for those who want to listen to Sandefur.

It is going to take a while to digest the totality of this ruling, as evidenced by the media chaos following the release of the decision. Wouldnt it be funny if Kennedy was on the right side of a decision, for a change?

That flushing sound is the sound of America going down the toilet.

Arizona, EPA, and now this.

While Obama himself rejected the idea it was a tax. So in other words, I see mountains of paperwork and nobody really knowing what to do and this with people's healthcare. Good luck everybody.

Tim Sandefur of the Pacific Legal Foundation analyzes the Obamacare decisions:

Good listening.

Totally shocked and bummed. Obamacare upheld. Chief Justice Roberts makes it a 5-4 decision. How this works politically? No one knows. We MUST tell the American voters it can be repealed.

It's rather disturbing reading what some of the more politically focused Republican pundits have to say about this ruling. Not so much about how damaging to the country and the constitution it is. More along the lines of "Hey look guys! This is great! The morons... errr... voters will REALLY vote for us in the coming election!"

Sad day when Republicans are celebrating this travesty of a ruling. No one is asking what *I* want to know... WTF was Roberts thinking?

The GOP wants to be back in power and gain the perks that come with that. As Rush is wont to say.

This will drive votes to the GOP but the practical thing they won't mention is that it is impossible to repeal Obamacare.

Even if they gain the Senate the Dems will still have way more than 40votes and will filibuster any bill coming from the House to change/repeal Obamacare.

Understand Obamacare provides 31 million more insured Americans. I saw that means these folks will get 15-20% more health care than they did as uninsured. That means millions of people burdening the same number of doctors and hospitals. This means many of us will have to wait for treatment. Rationing. And, yes, death panels. They don't call them that but that is what the The Independent Payment Advisory Board does. WASS

21 new taxes, 12 affecting families making less than 250,000, the same people Obama swore whose taxes would not be raised. But apparently it is ok for this sleaze to get away with this farce.

It's worse than that. As we boomers age, our Doctors age too. As we retire, so do our Doctors.

Warnings of Doctor Shortages

A Future Doctor Shortage?

Concerns of Doctor Shortages

Given the direction this administration is headed, with everything rationed and higher (as in doctor, for example) incomes facing even higher taxes, the disincentives for entering the healthcare field continue to grow.

Our children and grandchildren can expect to suffer poorer access to doctors and medical care.

Easily solved! Since the government is in charge of all student loans, it's an easy step to take to start mandating careers. Welcome to the USSA.
